
Who Qualifies for a USDA Loan Discrimination Claim?
A lot of people are talking about the recent news that the USDA is setting aside a $2.2 billion fund to compensate minority farmers and ranchers who were discriminated against.
One of the most common questions people are asking is “Who qualifies?”.
We’re answering this question, and we’re giving you some direction on what to do if you believe you may qualify for a compensation claim.
To qualify for a compensation claim of up to $500,000, the following conditions must be met:

The person signing up for a claim (claimant) must be a designated minority (Black, Hispanic, Woman, American Indian/Alaska Native, Asian, or Native Hawaiian/Pacific Islander)

The claimant must have applied for a USDA loan or attempted to apply for a loan before January 1st, 2021.

The loan must have been either denied or the loan had bad terms compared to loans provided to other local farmers, ranchers, or forestry landowners.(This could be high interest rate, frequent check-ins/reporting or special funding requirements).

The claimant must believe that they were discriminated against.
If these conditions have been met, it’s likely the person signing up for the claim will be entitled to significant compensation.

The USDA has indicated that they plan to make cash payouts by early next year. But, claimants must qualify by January 13th, 2024.
